The petitioner assails the validity granted in favour of Respondent No.4. The petitioner had approached the Committee, however, the Committee vide order dated 2.7.2015, refused to entertain the said grievance.

The Committee can entertain the application of the petitioner if the petitioner is in a position to point out any fraud or misrepresentation on the part of Respondent No.4 while getting the validity certificate. The Committee is required to make investigation and inquiry in that regard.

In light of that, the impugned order is quashed and set aside. The Committee shall inquire into the application of the petitioner and if it finds substance in the grievance made by the petitioner and if the Committee comes to the conclusion to reopen the case of the Respondent No.4 then the Committee shall pass order in that regard after hearing the petitioner and Respondent No.4 expeditiously. 5.
