THE STATE OF MAHARASHTRA ...
Advocate for Petitioner : Shri Yuvraj V. Kakde APP for Respondent-State : Shri S.D.Ghayal ...
CORAM : T.V.NALAWADE & M.G.SEWLIKAR, JJ.
DATE: 1st December, 2020 PER COURT:- 1.
Heard both the sides.
2.
A limited prayer is made to give directions to the Police to make correction in the registration number of Tempo, which is allegedly stolen. It appears that while registering the FIR the registration number of the vehicle is mentioned as MH-12 AQ3321, while the correct number of the vehicle is MH-12 EQ-3321. 3.
Learned APP for the respondent-State submits that summary report is already fled in the Court of JMFC and that report is accepted by the said Court as vehicle is not traceable.
{2} CRI.WP 219 OF 2020 4.
Even if the vehicle is not traceable and summary report is fled and it is accepted by the Court of JMFC, such correction can be made. There is certainty about registration numbers and things can be verifed on the basis of record, which can be collected from R.T.O. Ofce, Finance Company and also from the record, which is available with the Petitioner. 5.
This Court is hereby directing the respondent to verify the things and make corrections in the Police papers and request the learned JMFC Court to allow them to make correction in the report fled in that Court also. The Police are allowed to correct the copy of the FIR fled in the Court of JMFC and correct the record.
6.
With these directions, present proceedings is disposed of. ( M.G.SEWLIKAR ) ( T.V.NALAWADE ) JUDGE JUDGE SPT
