Learned advocate for the respondent states that in the present petition order passed in Miscellaneous Civil Appeal No. 24/2017 is challenged. In the said appeal, order passed by the Trial Court below Exhibit-5 in Regular Civil Suit No. 73/2012 was impugned. By placing on record a photo copy of decision in Regular Civil Suit No. 73/2012, he submits that the suit is dismissed by the Trial Court on merits on 19.08.2023. 2.
