a) Civil Application No.3370/2006:
The Respondent- Zilla Parishad, Osmanabad has challenged the award dated 30.12.2003 delivered in Reference IDA No.52/1996 thereby setting aside the oral termination of the Applicant and directing the Zilla Parishad, Osmanabad to reinstate the Applicant with continuity and full back-wages.
*2* ca.3370.5777.wp.3553.04.916 The Applicant submits that after filing of this Writ Petition, he has been reinstated and has subsequently superannuated. In the light of these submissions which are not controverted by the learned Advocate appearing for the Respondent- Zilla Parishad, the Civil Application No.3370/2006 is disposed of as being infructuous. No order as to costs.
b) Civil Application No.5777/2008:
By this Civil Application, the Applicant prays for an early hearing in Writ Petition No.3553/2004.
Since the Writ Petitions instituted in the year 1989 and onwards are being taken by this Court for final hearing on every Thursday, this Writ Petition cannot be given any precedence over old matters. For the above stated reasons, the Civil Application No.5777/2008 is rejected. The Petitioner is at liberty to renew his request after four months.
