The applicant / appellant submits that the appellant as well as the respondents are the L.Rs. of the deceased appellant No.2. The application suffers from delay of 118 days.

Since the L.Rs. of deceased appellant No.1 / Sunderbai are already on record as appellant No.1 and the respondents, the Civil Application is allowed and the delay is condoned without imposing costs. They shall, therefore, be treated as L.Rs. of the deceased in the Second Appeal.
