In this petition, by order dated 07.02.2025, while issuing notice for final disposal, this court recoded statement made on behalf of Respondent Nos. 3 to 5 that technical bid will not be opened till next date. The said statement made, continued to operate. 2.
Subsequently, additional affidavit dated 16.07.2025 was filed on behalf of Respondent No.3 in the light of Government Resolution dated 29.04.2025 being issued.

Learned counsel for the petitioner submits that this petition can be disposed of in the light of the statements made in paragraph Nos. 5 and 6 of the said additional affidavit, as the said statements address the grievance raised on behalf of the petitioner. 4.
Paragraph Nos. 5 and 6 of the additional affidavit read as under:- "5] That, the Deponent further say and submit that in the meantime, the Government of Maharashtra had issued a JPChavan Page 1 of 2
902wp1830-25 Resolution on 29.04.2025 thereby directing all the local bodies in the State of Maharashtra to implement the tender guidelines issued by Public Works Department titled as B-1 and B-2 of Tender Book for executing any work under the funds received from State Government, Central Government or own funds of the local body. As such, the Municipal Council Ambajogai is willing to undertake the tender process as per guidelines issued by Public Works Department especially in Government Resolution dated 27.09.2018.
6] In the light of above facts and circumstances, the deponent herein most respectfully say and submit that the deponent undertakes re-issue the tender for the work "Proposed Construction Various Road & Drain, Compound Wall & other Work under Maharashtra Suvarana Jayanti Nagarothhan Mahabhiyan Yojna" for Municipal Council Ambajogai Dist. Beed as per terms and conditions enumerated by Public Works Department in its resolution dated: 27.09.2018. In view of above, the writ petition may kindly be disposed of with liberty to this deponent to float fresh tenders in view of Government Resolution dated 29.04.2025." 5.
Considering the above quoted portion of the additional affidavit and statement made on behalf of the petitioner, the writ petition is disposed of.

The statement recorded in the order dated 07.02.2025 will no longer bind the said respondents.

Respondent No. 3 undertakes to abide by the statements made in the above stated paragraph nos. 5 and 6 of the additional affidavit. 8.
