This Court, by order dated 24th July 2025, had recorded that none is appearing for the petitioner since long. Petition is pending since 2021. It was specifically stated in the order that even if none appears today, this Court will decide the petition on merits. The petition, therefore, taken up for final disposal.

This petition is filed for quashing and setting aside the judgment and order dated 19th June 2018, passed by the learned JMFC, Aurangabad in PWDVA No. 524 of 2016 and for quashing and setting

( 2 ) aside the order 20th February 2020, passed by the learned Family Court, Aurangabad, in Petition No. E-209 of 2017.

By way of impugned order, the learned JMFC has allowed the interim application directing the petitioner to pay an amount of Rs. 3,000/- per months towards interim maintenance. The learned Judge, Family Court by impugned order directed the petitioner to pay Rs.5,000/- to the Respondent towards maintenance. 4.

This Court has gone through both the orders. It is considered that as per the averments in the application, the petitioner is getting Rs.50,000/- to 60,000/- per month towards rent of his properties. He is a doctor having income of Rs.20 to 30 lakhs per year. As against that, respondent does not have any income. In petition No. E-209 of 2017, the learned Judge, Family Court recorded that the main proceeding itself is withdrawn on 29th May 2017. It was directed that the respondent is entitled to get the maintenance only from 29th May 2017 till 22nd February 2020.

This Court finds that both the Courts have considered the pleadings and material before them. There is no illegality or perversity is found in any of the orders. There is no merit in the petition. The petition therefore stands dismissed.
