The Petitioner is aggrieved by the order dated 15.12.2016 passed by the School Tribunal, Latur by which the application Exhibit-17 has been allowed and the Petitioner/ original Appellant is directed to implead Mr.S.S.Mule as Respondent No.4 in the appeal. I have heard the learned Advocate for the Petitioner/ original Appellant.

There is no dispute that in paragraph 8 of the appeal memo, the Petitioner has specifically stated that the Respondent/ Management is interested in appointing the son or nephew of the Secretary in place of the

Consequentially, the Respondent/ Management moved an application to add Mr.S.S.Mule as Respondent No.4 in the appeal memo since he is the nephew of the Secretary. By the impugned order, the School Tribunal allowed the application and considering the allegations made by the Petitioner in the memo of appeal, permitted addition of Mr.Mule as Respondent No.4. The learned Advocate for the Petitioner submits, on instructions, that he would move a separate application for deleting paragraph 8 from the memo of his appeal before the School Tribunal and then Mr.Mule would not be necessary party in the proceedings. The above statement with regard to which this Court is not required to make any observation, this Writ Petition is dismissed for being devoid of merit.
