This is an application for permission to withdraw the amount of compensation deposited by the appellant-acquiring body, in terms of judgment and award dated 23.02.2016 by the Reference Court, Osmanabad in LAR No.35 of 2011.

There are averments in the application in justification of the prayer for withdrawal.

Having regard to the quantum of the amount of compensation, the applicant-original claimant deserves to be permitted to withdraw 75% of the amount.

Hence, following order.

The applicant is allowed to withdraw 75% of the

( 2 ) ca2344.21 amount deposited by the appellant-acquiring body, along with interest accrued thereon, on furnishing an undertaking to the satisfaction of the Registrar (Judicial), of this Court.

Balance 25% amount be invested in fixed deposit. 04.

The Civil Application stands disposed of.
