The applicant submits that paragraph No.8 of the order of this Court dated 28.1.2016 makes a mention of the Class and the Scale available to the Municipal Engineers in "A" Category Municipalities which is equal to the Executive Engineer in the same category. It is submitted that though the Scale is the same, there is a difference in the Grade Pay as per the Government Order issued by the Urban Development Department dated 28.5.2013, copy of which is at page No.15 to the Civil Application. He, therefore, submits that the said sentence in paragraph No.8 needs to be modified in order to make a mention that the Grade Pay is different as indicated in the Government Order dated 28.5.2013. 2.
Learned AGP for the respondents submits that the document dated 28.5.2013 speaks for itself and the Government stands by the said chart which has been supplied to the petitioner under the Right to Information Act.

In the light of the above, paragraph No.8 of the order dated 28.1.2016 shall read as under:- " 8.
As such, it is evident that the Class and the Scale available to the Municipal Engineers in "A" category Municipalities was equal to akl/d

BENCH AT AURANGABAD CIVIL APPLICATION NO. 2469 OF 2016 the Executive Engineer in the same category, with the difference in Grade Pay as is indicated by the Government decision of the Urban Development Department dated 28.5.2013. Similarly, the said Engineer and the Deputy Engineer in "B" Class Municipalities were also placed at par with difference in Grade Pay, as set out in the Government Order dated 28.5.2013. Scales of these cadres have already been made available to the petitioner The changed position from 2008 is enumerated in the affidavit-in-reply and notifications relied upon by the respondent."

In the light of the above this application is allowed with the modification in paragraph No.8 as above. Corrected copy of the order be issued.
