Heard rival submissions.

The applicant is seeking permission to withdraw entire amount of compensation which has been deposited by the appellant Acquiring Body.

The learned Counsel for the Acquiring Body remained absent. It is pointed out that the copy of this application is also not served upon him. However, considering the order dated 06.02.2025 in other connected matter, the applicant is permitted to withdraw 75% of the deposited amount of compensation i.e. 50% on usual undertaking and 25% on

(2) 942 CA-2605.2025.odt furnishing solvent surety/security to the satisfaction of Registrar (Judicial) of this Court.

The remaining amount be kept in FDR in any nationalized Bank on yearly renewal basis till final disposal of this appeal.
