Mr. Kedar, learned counsel submits that the petitioner is elected as member of Grampanchayat from OBC (woman) category. The post of Sarpanch is reserved for SC (woman). According to the learned counsel, not a single SC (woman) candidate is available.

The learned A.G.P. submits that in case, the woman candidate of SC or ST is not available, then the Collector/Authority would proceed in accordance with Rule 4(A) of the Maharashtra Village Panchayat (Sarpanch and Up-Sarpanch) Election Rules, 1964.

In view of that, Writ Petition is disposed of. No costs.
