A report has been received from the jail authority where the appellant was lodged, i.e. the Aurangabad Central Prison. Due the ailment, the appellant was admitted to Ghati Hospital on 04.02.2023, however, while undergoing treatment he expired on 06.02.2023 at 01.10 p.m. In view of the said fact coming on record from the authentic authority, there is no need to have death certificate. The report also states that the fact was informed to the relatives and thereafter the dead body was handed over. Even the local police as well as the Executive Magistrate, Aurangabad were present at the time of inquest panchanama and the postmortem has been done with a video shooting. Under said circumstance, the appeal stands abated.
