This is the Application for condonation of 32 days delay in preferring Application for Leave to Appeal (ALP) by the Victim, against the Order dated 01.08.2024 passed by the learned Judicial Magistrate First Class, Badnapur in SCC No.168/2017, whereby the Respondent was acquitted.

The learned Advocate for the Applicant submits that sufficient reasons are given for not preferring the Application within the stipulated time. He submits that the Application may be allowed. 3.

The Application is opposed by the learned Advocate for the sole Respondent. He submits that no sufficient reasons are shown in the Application and the same may be rejected.

On hearing both the sides and for the reasons mentioned in paragraph no.2 of the Application, the Application is allowed in terms of prayer clause 'B'.
