The FIR dates back to October, 2012, charge-sheet filed in 2014. We have perused the FIR and relevant provisions of the Maharashtra Prevention of Defacement of Property Act, 1995. We are not inclined to issue notice, learned advocate for the applicant therefore come around to withdraw the application with direction to the trial Court to expedite the hearing of the matter. 2.

Since the case is old one, we request the trial Court to expedite the hearing thereof. If for one or other reason the presence of co-accused could not be secured, the trial Court can separate the trial of the applicant in exercise of powers under section 317 of the Criminal Procedure Code.
