Chandar Gundappa Takbide v. The State Of Mah And ANR
1 932-CA-4000-17
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 932 CIVIL APPLICATION NO. 4000 OF 2017 IN RC/1020/2012 CHANDAR GUNDAPPA TAKBIDE
VERSUS
THE STATE OF MAH AND ANR ...
Advocate for Applicants : Mr. S.N. Patil, h/f Mr. S.K. Sontakke AGP for Respondents: Mr. S.R. Yadav CORAM : K.K. SONAWANE, J.
DATED : 14th SEPTEMBER, 2017.
Order :- 1.
Heard learned counsel for the applicant and learned AGP for respondent No. 1. Despite service none appears for respondent No. 2 Acquiring Body.
2.
Perused the application. First Appeal Stamp No. 21812 of 2012 and application for condonation of delay bearing Civil Application Stamp No. 21813 of 2012 were not allowed to be registered for non removal of objection within stipulated period. Accordingly, Learned Registrar (Judicial) passed the impugned order on 30-10-2012. Since then the applicant remained idle and did not take any steps till filing of present application in the month of February, 2017. It appears that the applicant appears to be very negligent and careless, therefore, there is no propriety to allow the application. Thus, I do not find any sufficient cause to condone the delay for further hearing on application for restoration of original proceedings by recalling impugned order of refusing registration of the proceedings. In sequel, the application stands rejected. No order as to costs.
