Submission is made by the learned advocate for the respondent No. 3/bank that, new policy for One Time Settlement (OTS) has been introduced on 30th August, 2019. The petitioners/borrowers have been intimated about the same and it is for the petitioners to either accept the said offer or not. 2.

We had under our order dated 18.06.2019 directed the petitioners to deposit Rs. 1,00,00,000/- (Rs. One Crore only). The same was without prejudice to the rights and contentions of either of the parties. The learned counsel for the petitioners submits that, the petitioners have deposited the said amount

In case, fresh proposal is given by the bank, then amount of Rs. 1,00,00,000/- (Rs. One Crore only) deposited by the petitioners under order of this Court shall be adjusted while considering the fresh proposal.

The learned counsel submits that, 5% amount deposited by the petitioners towards the OTS proposal given to earlier scheme be refunded. The petitioners may make a request with the bank, which the bank would consider on its own merits. 5.

In view of the above, the writ petition is disposed of. No costs.
