Considering that the interlocutory order of the Labour Court dated 19/08/1997 granting interim relief u/s 30(2) of the MRTU and PULP Act, 1971, has been impugned, the hearing in this matter was adjourned on 30/06/2017 to enable the litigating sides to gather information as regards the pending Complaint (ULP) No.72/1997 before the Labour Court.

Mr.Joshi, learned Advocate appearing on behalf of the original complainant / workman submits that Complaint (ULP) No.72/1997 was allowed by the Labour Court by a judgment. The revision petition filed by the petitioner u/s 44 was also dismissed and a writ petition preferred by the petitioner was also dismissed. The respondent had been reinstated in service and has now retired after khs/JULY 2017/4880

attaining the age of superannuation. Back wages were also paid. 3.

Considering the above, Mr.Salunke, learned Advocate submits that this petition can be disposed of as being infructuous in the light of the statements of Mr.Joshi.

Considering the above, this petition is disposed of as being infructuous. Rule is discharged.
