The applicant apprehends arrest in Crime No. 325/2022, registered with Sonai Police Station, Ahmednagar, for offences under sections 307, 143, 147, 148, 149, 452, 324, 323, 504, 506 of the Indian Penal Code.

FIR is lodged by Rahul Jadhav against six accused persons alleging that he was assaulted by accused persons with sword like weapon, iron fighter and beer bottles. 3.

Heard the learned advocate for the applicant and learned Additional Public Prosecutor for respondents. Perused the investigation papers.

Chargesheet in the present crime is filed on 31.12.2022 and case is numbered as Regular Criminal Case No. 38/2023. Against the present applicant charge sheet is filed under section 299 of Cr.P.C. Co-accused against whom allegation of assault by weapons is made are arrested and from them weapons allegedly used in the crime are recovered. 5.

Against the present applicant allegation in the FIR is that he gave fist blow on the face of informant. Injury certificate, prima facie, does not support the said allegation. Considering the role attributed to the present applicant and the fact that investigation is complete, applicant is entitled for protection. 6.

In the event of arrest of applicant in connection with 325/2022, registered with Sonai Police Station, Ahmednagar, for offences under sections 307, 143, 147, 148, 149, 452, 324, 323, 504, 506 of the Indian Penal Code, applicant shall be released on executing personal bond of Rs. 15,000/- with one surety in the like amount. Applicant shall not tamper the prosecution evidence.
