The applicant is seeking pre-arrest bail in Crime no. 17 of 2016 registered at Deopur West Police Station, Dist. Dhule for the offences punishable under section 498(A), 323, 313, 504, 506 r/w. 34 of the Indian Penal Code.

It is claimed that the incident took place between February 17, 2010 and January 30, 2016. The
2 Cri. Appln. 950-2016 prosecution case against the present applicant is that the applicant was married to the complainant Deepawali on 17/2/2010. It is then claimed that the applicant was an alcoholic person and complainant was tortured for the demand of dowry.

During the course of hearing, both the learned counsel have invited my attention to the panchanama / acknowledgment drawn on 16/6/2016, wherein the complainant Deepawali visited the place of the applicant and she was handed over all her belongings. It is then to be noted that the parties have also filed proceedings for divorce by mutual consent, in which it was agreed between the parties, that they would withdraw the respective complaints preferred against each others.

In view of above, in my opinion, custodial interrogation of the applicant is not required. Hence, the following order:-

In the event of the arrest of the applicant in Crime no. 17 of 2016 registered with Deopur West Police Station, Dist. Dhule for the offences punishable under section 498(A), 323, 313, 504, 506 r/w. 34 of the Indian Penal Code, he be released on bail upon his executing P.R. bond in the sum of Rs.15,000/- (Rs. Fifteen Thousand) with one surety in the like amount.

Criminal Application stands disposed of accordingly.
