By this Civil Application, the Applicant prays for condonation of delay of 130 days caused in filing this Civil Application for bringing the legal representatives of the sole Respondent on record. The notices have already been issued in this matter on 02.12.2011. Mr.Chapalgaonkar appears on behalf of the Respondent No.1/1.
None for the Respondent Nos.1/2 to 1/4.
The Applicant prays that the legal representatives of the
*2* 17.ca.2453.11 Respondent No.1 be brought on record by condoning the delay which is about 130 days. The reasons in support of the condonation of delay are set out in the application.
Mr.Chapalgaonkar opposes the application on the ground that the reasons cited are not satisfactory.
In the light of the above and for the reasons set out in the Civil Application, the same is allowed. The delay of 130 days caused in bringing the legal heirs of the Respondent on record is condoned, subject to the Applicant paying costs of Rs.1000/- to be deposited in this Court within a period of TWO WEEKS from today.
After depositing the costs, the Applicant shall bring on record the legal heirs of the deceased Respondent within a period of THREE WEEKS thereafter. The Respondents are at liberty to withdraw the said costs in equal proportion.
In the event this order is not complied with, the same shall stand recalled and then the Civil Application shall stand rejected. (RAVINDRA V. GHUGE, J.)
