PER COURT :- Counsel appearing on behalf of the petitioner, states on instructions that, the petitioner is dead. The present petition arises out of the order passed by the Joint District Judge, Dhule under Application tendered by the respondent under section 56(A) of the Bombay Public Trust Act. Since the petitioner is dead and as the matter relates to proceedings under the Bombay Public Trusts Act, the writ petition is rendered infructuous. Even otherwise, the District Court was directed to decide the pending proceedings in accordance with law. The writ petition is presented in 1998 and in all probabilities, the pending proceedings must have been decided.

In this view of the matter, writ petition stands disposed of. Rule is discharged.

There shall be no order as to costs.
