This matter was heard for sometime.

The learned Advocate for the Petitioners submits, on instructions, that the Petitioners desire to withdraw this petition. A disturbing factor is noticed by this Court that these Petitioners have moved an application Exhibit-29 before the learned District Judge-9, Aurangabad wherein, the Petitioners have expressed loss of faith in the said judge. The learned Advocate appearing for the Petitioners in this Court is signatory to the said application Exhibit-29. After considering the above fact, I was of the prima facie opinion that the action needs to be initiated for the said conduct. However, the learned Advocate for the Petitioners submits that the

*2* 955wp2171o182202 Petitioners as well as the learned Advocate himself, would file individual apology applications before the learned District Judge-9, Aurangabad who is dealing with MARJI No.315/2015 and shall withdraw their contentions set out in their application Exhibit-29.

Considering the above, this Writ Petition is disposed of as withdrawn.

The statement of the Petitioners and the learned Advocate Shri Shripad Kulkarni is recorded that they would tender an individual apology before the concerned Judge as noted above. Such apology shall be tendered on or before 09.03.2018.

The learned Registrar (Judicial) would place a copy of this order before the concerned Judge. The learned District Judge-9 would intimate the learned Registrar (Judicial) of this Bench as to whether, the Petitioners and their Advocate have complied with the above direction. kps (RAVINDRA V.
