Heard learned Counsel appearing on behalf of the applicants and learned Addl. Public Prosecutor on behalf of the respondent. 2.
This Application can conveniently be disposed of by restoring the interim protection ordered by learned Additional Sessions Judge, Gangakhed on 5th January, 2016, subject to following conditions :- (a) Applicants no.1 and 2 undertake to appear before learned Additional Sessions Judge, Gangakhed on 25th February, 2016. Personal appearance of applicants no.3 to 5 before learned Additional Sessions Judge, Gangakhed till the decision on the bail application
criap962.16 (2) is dispensed with, particularly having regard to the reasons narrated in the application Exh.14 moved on 4th February, 2016 before learned Additional Sessions Judge, Gangakhed. (b) Even otherwise, it is required to be noted that the complainant has roped all the family members of applicant no.1 - husband as accused in the crime and the fact remains that applicants no.4 and 5 are not residents of the place where applicant no.1 is residing. (c) In the background of the above referred undertaking and the cause cited in application Exh.14, interim protection granted to the applicants is extended till final decision of the application. (d) Learned Additional Sessions Judge, Gangakhed shall decide the application without being influenced by the observations made herein above.
Criminal Application stands disposed of in above terms. (N.W. SAMBRE, J.) amj
