The grievance of the petitioner could have been valid in 2004 when this petition was filed. The petitioner was seeking appointment as Teacher. He applied for the said post and was interviewed etc. The advertisement even then mentioned that there would be reservation for the Special Backward Class category, and the petitioner belonged to such category. The petitioner was not given appointment. Instead the management appointed respondent no.7 who did not belong to Special Backward Class category. The Government did not approve appointment given to respondent no.7. Therefore, the post remained vacant

2 WP 2625/2004 and no one was appointed on such post. The petitioner made reservation to Education Officer but no action was taken. In reply the Government has said that the advertisement itself was erroneous because there was no sanction for reserved post for Special Backward Category.

The petitioner is absent. Interim relief was also not granted to the petitioner. We assumed that in the light of absence of petitioner and his Advocate before the Court, the petitioner has secured some other job and that now he is not interested in this petition. In view of this, the petition stands dismissed.
