The applicant is apprehending her arrest in connection with Crime No.4 of 2022 registered with Ashti Police Station, Dist. Beed, for the offences punishable under sections 307, 326, 325, 385, 327, 323, 504, 506, 143, 147, 148, 149 of the Indian Penal Code.

Heard Mr.M.P. Gandle, learned Advocate for the applicant and Mr.B.V. Virdhe, learned APP for the respondent/State. In order to cut-short, it can be stated that both of them have vehemently made submissions in support of their respective contentions.

Perusal of the FIR would show that it has been lodged by one
( 2 ) Satish Babasaheb Dhas on 06.01.2022 in respect of the incident that had allegedly taken place at 08.30 p.m. on 29.12.2021. Though there appears to be apparent delay in lodging the FIR, however, that can be explained by the prosecution during the course of the trial. The name of present applicant appears to be in the form that she is wife of Sandip alias Dada. No specific role has been attributed to her. However, her presence has been stated. Learned APP submits that she being a member of unlawful assembly, had common object and then the informant was assaulted severely with an intention to commit his murder. Some other persons have also received injuries. Medico-legal certificate of the informant states that he had sustained two injuries; one is CLW over right parieto occipital region and the nature of the injury is grievous.
Second is on the linear undisplaced fracture of right high parietal bone. It is also stated be grievous. One Bharat Shelar has sustained fracture to his left metacorpal bone. It is stated to be grievous. Abasaheb Shelar has received CLW over high parietal region (sutured outside) and it is stated to be simple. Police papers would also show that statements of witnesses have been recorded under sections 161 an 164 of the Cr.P.C. All of them have not attributed specific role to present applicant though they have stated about presence of the applicant.

Under such circumstances, interim protection granted by this Court to the applicant on 01.04.2022 deserves to be confirmed. Accordingly, it is confirmed.
