Heard the learned advocate for the applicant accused, the learned APP and the learned advocate for the original informant. 2.
The applicant was granted bail by the order dated 10.12.2019 inter alia putting a condition that he would deposit Rs.50,00,000/- within three weeks of his release on bail and the remaining Rs.50,00,000/- to be deposited in two installments during next four months. Though the applicant deposited Rs.50,00,000/- within three weeks of his release on bail he failed to deposit the remaining amount of Rs.50,00,000/- as was directed. The present application has been filed to deposit that remaining amount of Rs.50,00,000/-.

The learned prosecutor submits that as per the observations of this Court while granting bail this amount was supposed to be disbursed to 1/2
950.Appln.369.21.odt the depositors in the event of the matter ending in conviction. The ultimate beneficiary being the depositors the amount could be allowed to be deposited.

The learned advocate for the original informant submits that he has no objection if the money is deposited even though he has filed application for cancellation of bail for the self same reason. 5.
Considering all the aforementioned aspects, the Application is allowed. The applicant is allowed to deposit Rs.50,00,000/- pursuant to the order dated 10.12.2019 passed in Bail Application No.639/2019 by 15.02.2021 in the District Court.

Consequently the order dated 28.01.2021 on Application No.432/2020 stands recalled.
