We have heard learned counsel for the applicant-original accused. Learned counsel submits that this application for suspension of substantive part of sentence and bail is filed only on the ground of health issue of the applicant.

In the order dated 28.7.2021, we have recorded the submission of learned counsel for the applicant on health issue. The applicant is HIV positive. Since learned counsel appointed has no specific instructions of the present health condition of the applicant, who is in jail and details about the treatment being given to him with requisite diet, we have requested learned A.P.P. to call specific report from the concerned Medical Officer, attached to the jail. 3.
Learned A.P.P. has submitted the papers before us today. We
cran370.21 -2have carefully perused the same. The Chief Medical Officer, Aurangabad Central Prison has submitted the medical report of the applicant by issuing a certificate to that effect dated 5.8.2021. It is stated in the said certificate that the convict prisoner Ram Shrimant Piske is HIV positive and taking antiretroviral Therapy (ART) regular treatment and follow up at ART Center, Government Medical College and Hospital, Aurangabad with his regular diet, additional medical diet eggs, milk, groundnut, jaggery and Soyabin provided to him daily and regularly. It is further certified that at present the general health condition of the applicant convict is stable and satisfactory. Whenever required he will be referred to Government Medical College and Hospital, Aurangabad 4.
In view of above, we find no substance in this application. Hence, we proceed to pass the following order:-
O R D E R
Criminal application is hereby rejected.
