PER COURT :

1) Heard. A limited grievance made in this petition is that, without hearing the petitioner or without adhering to the Roaster, the Education Officer has cancelled the approval to the appointment of the petitioner as Assistant Teacher.

2) Upon perusal of the impugned communication/order, it does not appear that the petitioner or the management is heard or the Education Officer has personally perused the Roaster.

3) In the light of above, we deem it

appropriate to set aside the impugned communication and direct the Education Officer to hear the petitioner and management and after considering the roster, take appropriate decision in regard to approval to the appointment of the petitioner.

4) Needless to observe that we have not expressed any opinion on merits of approval and it is for Respondent no.2 to take appropriate decision, as expeditiously as possible and preferably on or before 30th May, 2015.
