The petitioner possesses a certificate of validity with a superimposed rubber stamp mentioning "conditional validity". 3.

When Rule 12(7) and 12(9) of the Rules of 1983 framed under the Maharashtra Act XXIII of 2001, prescribed a specific Form G for issuance of a certificate of validity, no such condition could have been superimposed with rubber stamp.

The learned A.G.P., on instructions, submits that the committee would immediately issue a fresh certificate of validity in correct form, once the petitioner surrenders the earlier one.

The writ petition is disposed of with a direction to the petitioner to approach the committee, surrender the original certificate and have a fresh one in the corrected form.
