The learned counsel for the petitioner submits that, the post of Sarpanch of Gram Panchayat Palasgaon, Tq. Wasmat is never reserved for S.C. category since the year 1995. According to the learned counsel considering the S.C. population of the Gram Panchayat, the post of Sarpanch now ought to have been reserved for S.C. category.

We have heard the learned Assistant Government Pleader for respondents/State and Mr. Kadethankar, the learned Advocate for the Respondent/Commission.

The petitioner could not point out that, posts reserved for

2 wp 2826.21 S.C. in other gram panchayats of the taluka are having less population of S.C. than the petitioner's gram panchayat. In absence of entire data, it will not be possible to conclude about the reservation of the post of Sarpanch of said gram panchayat. 4.

In the light of the above, the writ petition is disposed of. No costs.
