Mr.Bayas, learned counsel submits that validation proceeding in respect of the tribe claim of the petitioner is pending. The respondents have terminated the service of the petitioner under the order dated 10.09.2012 is passed as the validation proceeding is pending. The petitioner is entitled for reinstatement. 2.

Mr.M.K.Goyanka, learned counsel submits that the prayer for reinstatement has been negatived by this Court in writ petition No.8578/2012 under the order dated 24.01.2013 and also in writ petition No.7147/2014 vide order dated 05.02.2015. This Court has observed that in case the claim of the petitioner is validated then he can claim for reinstatement.

In view of the earlier orders referred to above directions for reinstatement of the petitioner cannot be given at this stage. It is submitted that the matter is kept for hearing before the Committee on 20.12.2017. The petitioner shall appear before the Committee on 20.12.2017, thereafter the Committee shall dispose of the matter expeditiously, preferably within four months from the date of appearance. The petitioner shall co-operate in expeditious disposal of the said proposal. The writ petition stands disposed of. No costs.
