Mr. Sonkawade, the learned counsel submits that under Rules 2019i.e. the All India Services (Performance Appraisal Report) (Amendment) Rules, 2019, remedy is provided of giving representations, more particularly under Rule 8.2. The same has to be given within 15 days. The petitioner was posted as Election Observer at Jharkhand for State Assembly election held in the month of December, 2019 and he returned on 14th December, 2019. As such the petitioner could not submit representation within 15 days as required under the Rule.

The petitioner may submit his representation to the authority as per Rule 8.2 of the Rules 2019 within seven days from today. 3.

If the petitioner submits the representation within seven days from today, then the authority i.e. respondent no.1 may consider the same on its own merits and take decision in accordance with law. 4.
