We have heard Mr. Deshmukh, learned counsel for the petitioner.

Learned counsel for the petitioner submits that the post of Sarpanch of Grampanchayat Wavadade is reserved for S.C. category. The petitioners are elected from General and O.B.C. category respectively. The post of Sarpanch ought to have been reserved for other than S.C. category.

The petitioners are not in a position to place on record the data for the post of Sarpanch was reserved from 1995. In absence of the relevant data, it could not be possible to come a definite conclusion. 3.
