By this application, the applicant, original complainant before the Industrial Court, seeks leave to withdraw the amount deposited by the employer Bank in this Court. He submits that, by the order dated 30.04.2019, the petition was dismissed. The Bank approached the Hon'

ble Apex Court by preferring Special Leave to Appeal. By order dated 09.12.2019, the appeal was disposed of with liberty to the Bank to pray for installments before this Court. The Bank approached this Court for installments and the civil application has been decided. 2.

It is informed that an amount of Rs. One crore and odd was deposited as a first installment and another quantum of Rs. One crore and odd was deposited as second installment. The Bank has prepared a list of the employees, indicating their respective shares from the deposited amount. The applicant has given no objection to such list. A

07ca2775-22 copy of the said list is placed on record which is marked as ' X-1' for identification. Name of the applicant Nandkumar Sadashiv Kulkarni is found at Serial No. 12 and his share would be Rs.1,37,011/- in each installment.

The learned Advocate for the Bank opposed this application. 4.

Considering the above and as the right of the applicant has been crystallized with the dismissal of the Special Leave Petition filed by the Bank, this application is allowed and the applicant would be permitted to withdraw the amount of his share without condition, on proper identification by the learned Advocate. While withdrawing, the latest colour photograph of the applicant, copy of the Adhar Card, copy of the Election Identity Card and copy of the latest permanent address proof, shall be placed on record.

If the Bank details are furnished by the applicant, subject to the compliance of the above, the amount can be transmitted to his Bank account by RTGS.
