Mr. Kedar, learned counsel submits that the petitioner is elected as member of Grampanchayat from SC category. The post of Sarpanch is reserved for SC (woman). According to the learned counsel, not a single SC (woman) candidate is available.

The learned A.G.P. submits that in case, the woman candidate of SC or ST is not available, then the Collector/Authority would proceed in accordance with Rule 4(A) of the Maharashtra Village Panchayat (Sarpanch and Up-Sarpanch) Election Rules, 1964.

In view of that, Writ Petition is disposed of. No costs.
