Mr.Deshmukh, learned counsel for the Petitioners submits that the Petitioners' services from the initial date of appointment is required to be considered for all service benefits. However, the same is not considered. Even the Headmaster i.e. Respondent No.3 has forwarded the representation to Respondent No.2 (Exhibit - 'G') for giving the benefits considering the initial date of appointment. However, no decision is taken on the same as yet though it is pending since 2013.

24 wp.1840.15 ors.odt Mr.Shinde, learned AGP submits that in case the said representation is pending, then the Education Officer would decide it on its own merits, in accordance with law and the policy. In light of the fact that the representation forwarded by the Headmaster to the Education Officer to consider the initial date of appointment of the Petitioners for the purpose of service benefits is pending, we are not entering into other merits of the arguments canvassed by the learned counsel for respective parties. In the result, we pass the following order:

I.

The Respondent No.2 shall decide the representation (Exhibit - 'G') in respect of the service benefits of the Petitioners, on its own merits, in accordance with law, expeditiously, preferably within four months. II.

Accordingly, all the writ petitions are disposed of. No costs.
