Heard learned Counsel for the Petitioner.

The complaint filed by the Petitioner is dismissed by the Labour Court so also the Revision filed against the order of Labour Court is dismissed by the Industrial Court holding that the Petitioner's termination is upheld in the earlier proceedings and thus for the same termination, fresh grievance cannot be raised. 3.

Perused the order dated 09/01/2008 in Writ Petition No. 2574/2007, wherein this Court has dismissed the challenge to the 908 WP 6647.2025.odt

termination of the Petitioner in the year 2000. The order passed by the Labour Court and the Industrial Court was confirmed by this Court and this Court held that the termination of the Petitioner is not unlawful. Thus the Courts below have rightly rejected the fresh complaint challenging his termination.

In view of this, Petition stands dismissed.
