At the outset, learned counsel for the petitioner prays for withdrawal of this petition as the petitioner wants to avail the alternate remedy of approaching the Magistrate for seeking directions under Section 156(3) of the Code of Criminal Procedure. If such prayer is made before the Magistrate as indicated above, it shall be decided on its own merits in accordance with law.
