Learned Additional Public Prosecutor submits that after filing of the present application, on 16/02/2023, section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act is added in the present crime. In that view of the matter, the applicant has to approach the Sessions Court again.

Learned advocate for the applicant, therefore, seeks permission to withdraw the application with liberty to approach the Sessions Court again.

The application is disposed of as withdrawn with liberty as prayed for.
