1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 31/2025, registered with Jintur Police Station, Taluka Jintur, District Parbhani, for the offence punishable under Section 75 (1) and 333 of the B.N.S.
3] This Court, by order dated 24.02.2025, has granted interim protection in favour of the applicant for the submissions and reasons stated in para nos. 4 and 5, as noted below :
3] The allegation against the present applicant is that he caught hold the hand of the informant and demanded sexual intercourse and thereafter when the informant raised alarm the applicant / accused ran away.
4] The learned counsel for the applicant submits that applicant is residing at different place and he is 70 years of age while the informant is 28 years of age. The learned counsel for the applicant submits that the applicant is falsely implicated in the alleged crime.
4] The learned counsel for the applicant submits that in pursuance of the aforesaid order, the applicant has attended the concerned police station and has co-operated with the investigation. He further submits that the applicant is working at Pune whereas the incident is said to have happened in village Pangari, Taluka Jintur, District Parbhani.
5] The learned APP submits that the applicant is permanent resident of village Pangari although he is working in Pune and that there is possibility that the applicant may pressurize the informant and the witnesses. 6] The learned counsel for the applicant submits that he will not enter the village Pangari, Taluka Jintur, District Parbhani, for a period of one year. He further submits that the applicant has to go to the village only to
collect grocery. However, the applicant submits that he would collect the grocery through some other person. 7] Considering the same, the interim protection granted by order dated 24.02.2025 stands confirmed in the following terms :
i] The applicant shall attend the concerned police station as and when required by the investigating officer.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
iv] The applicant shall not enter the village Pangari, Taluka Jintur, District Parbhani for a period of one year except to attend Police Station.
8] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
9] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
10] The application stands disposed of.
