We had passed an order on 15/07/2021 as under :- "1. Mr.Yawalkar, learned A.G.P. assures to supply a copy of the Affidavit to Mr.Bora, learned Advocate for the petitioner. Mr.Bora submits that though his tender bid was accepted, the work was not allotted to him and the tenure of the work contract was till February 2020. As such, either the Government has to extent the contract or it has to return the deposit amount along with interest.

2. Mr.Yawalkar, learned A.G.P. to take instructions.

3. Stand over to 20/07/2021 for passing orders." 2.

The learned AGP has placed before us a communication dated khs/July 2021/2464

- 2 - 28/07/2021 issued by the Joint Secretary, State of Maharashtra Shri D.R.Dingale, addressed to the Commissioner, Social Welfare Department/respondent No.2 stating therein that the entire earnest deposit amount deposited by the petitioner with the Government, be returned to the petitioner. We have taken the copy of the said communication (2 pages) on record and which is marked as "X" for identification.

The learned Advocate for the petitioner submits on instructions that the petitioner is satisfied with the communication and prays that some time limit within which the money could be returned to the petitioner. , be ordered. The learned AGP submits that this can be done within 3 weeks. 4.

In view of the above, we are granting time to the State Government upto 30/08/2021 to return the said earnest deposit amount by depositing it in the bank account of the petitioner, details of which are available with the respondent/Department.
