Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant is the son of the main accused Sunita and the cousin of the deceased. The prosecution has a case that the deceased was forced to steal Murum. When he denied, he was harassed. Hence, he committed suicide in a Well. The applicant appears to have one of the labours allegedly stealing the Murum. The material investigation against the applicant has been completed. He is a young boy of 21 years old having no antecedents to his discredit. In the circumstances, the application deserves to be allowed. Hence, the following order :

(i) Bail Application is allowed.

(ii) Applicant SHIVAM @ SHIV JAYPALSING BAYAS be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.30 of 2023, registered by Police Station Murum, District Osmanabad, for the offence punishable under Section 306 read with Section 34 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing of the charge sheet. (S. G. MEHARE, J.) ...
