Learned Advocate for the petitioner submits that despite his efforts, he is unable to contact the petitioner. Though a letter was sent on the address mentioned, there has been no response. 2.

The petitioner had filed an application under Section 33-C(2) of the Industrial Disputes Act, 1947 before the Labour Court seeking recovery of Rs.1,06,665/-. The Labour Court recorded the payments made to him earlier by the employer and concluded that an amount of Rs.37335/- needs to be paid.

None of the learned counsel appearing for the litigating sides are aware as to whether the said payment has been made or not. akl/d

In view of the above, it appears that the petitioner has lost his interest in the matter. This petition is, therefore, disposed off. Rule is discharged.

However, in order to put an end to this litigation, keeping in view that the petitioner was of 64 years of age in the year 2000, in the event respondents 3 and 4 have not paid the amount as directed by the Labour Court, the said amount shall be deposited in this Court along with interest at the rate of 6% per cent per annum from the date of filing of this petition i.e. 19.12.2000, within three months from today. After the amount is deposited, the petitioner would be at liberty to withdraw the said amount within a period of three months. If the amount is not withdrawn, it shall be transferred to the High Court Legal Services Authority, Sub-Committee, Bench at Aurangabad. ( RAVINDRA V. GHUGE, J. ) ...
