Heard learned Counsel appearing for the applicant - wife. The respondent husband, though served with notice, but remained absent.

The applicant - wife is seeking transfer of Marriage Petition No. 333 of 2022 pending in the Court of CJSD, Ahmdenagar filed by respondent - husband for restitution of conjugal rights, to the Court of CJSD, Ambad, District Jalna. 4.

According to the applicant-wife, she is not having any source of income. The distance between Ambad and Ahmednagar is more than 215 Kms and therefore, it would be difficult for the applicant to attend the dates at Ahmednagar without any financial support. Moreover, she has also filed two proceedings against the respondent - husband at Ambad. There is no oppose to this application and therefore, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

2 957 mca 51-23 (ii) The Marriage Petition No.333 of 2022 pending in the Court of CJSD, Ahmednagar is transferred to the Court of CJSD, Ambad, Distrcit : Jalna for disposal according to law.

(iii) The respondent is directed to appear before CJSD, Ambad, District, Jalna on or before 15/07/2023.

(iv) The application is disposed of accordingly.
