IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 7783 OF 2017 Mohan Laxman Garad PETITIONER

VERSUS

Chandrakala Pandurang Vaidya and Others RESPONDENTS .......

Mr. N. B. Narwade, Advocate for the petitioner Mr. S. N. Kendre, AGP for respondent - State .......

[CORAM : SUNIL P. DESHMUKH, J.] DATE : 21 st JUNE, 2017 ORDER :

1.

Heard learned advocates for the parties.

2.

Looking at the impugned order, it appears that an alternate remedy is available to the petitioner under Maharashtra Land Revenue Code, 1966 against the same. Learned advocate submits that the petitioner may not be relegated to alternate remedy for, the petitioner is aged 75 years.

3.

However, looking at that there is alternate remedy available, it would be expedient that petitioner avails of the same. In such a case authority concerned may proceed with the same expeditiously and dispose of the same preferably within

{2} wp7783-17 four months after petitioner moves the authority. Needless to refer to that time consumed in prosecuting present writ petition will be required to be given treatment in accordance with law if it comes to condonation of delay.

4.

Writ petition, as such, stands disposed of letting the petitioner to avail of alternate remedy as available under law. [SUNIL P. DESHMUKH, J.] drp/wp7783-17
