The petitioner herein has claimed for release of amount due to him towards leave encashment. He also prayed for interest on delayed payment of the said amount. The reason for withholding of the same is the initiation of departmental enquiry against the petitioner.

Learned advocate for respondents although strongly objected the grant of relief, the fact is that the departmental enquiry initiated against the petitioner has been quashed by vide order dated 03.10.2025 passed in Writ Petition No.457 of 2022. In the sequel, the petitioner would be entitled to all the monetary benefits which have been withheld on account of initiation of departmental enquiry

(2) against him. Since the subject matter of this writ petition is the leave salary for six months said to have been withheld on account of departmental enquiry, we direct the respondents to release the said amount forthwith to the petitioner along with 6% p.a. interest thereon, leave salary has been paid on 31.12.2021. It was payable from 01.11.2018.

We therefore direct the respondents to pay the petitioner 6% p.a. interest thereon on the amount of leave salary for the period from 01.11.2018 to 31.12.2021.
