Applicant seeks grant of regular bail on account of his arrest in crime no. 246 of 2024 registered at Hasnabad Police Station, District Jalna for offences punishable under Sections 20(b)(ii) and 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). 2.

Learned counsel submitted that applicant is arrested in above crime on 19.10.2024. There are allegations that contraband in

-2commercial quantity was being transported in a vehicle. That, now investigation is over and charge sheet is already filed in December 2024 and therefore, no further custody is required. That, no recovery or discovery is shown to be made at the instance of the applicant. That, applicant is ready to abide all and any conditions imposed by this Court, and hence, learned counsel urges for grant for bail. 3.

Though, learned APP opposed on the ground that huge commercial quantity is detected in the vehicle and that, applicant was found to be involved, however, learned APP admitted that charge sheet is now filed, i.e. on 17.12.2024. Therefore, further course of trial is uncertain. No further recovery is shown to be made. Statement is made across the bar by learned counsel that applicant has no criminal antecedents. Taking above facts into consideration, applicant succeeds. Hence, I proceed to pass the following order:

ORDER

I.

The application is allowed.

II.

Applicant Narayan s/o Krushna Ingale be released on bail in connection with Crime No. 246 of 2024 registered at Hasnabad Police Station, District Jalna, on executing Personal Bond of Rs. 15,000/- with one surety in the like amount, on the following conditions: [a] The applicant shall not tamper prosecution evidence.

-3- [b] The applicant shall not leave the area of jurisdiction of the concerned police station till conclusion of trial. [c] The applicant shall attend the concerned police station once in every week i.e. on every Monday, between 11.00 a.m. to 02.00 p.m. till committal of the case and thereafter, shall regularly attend each and every effective date before the trial court.
