This application is filed by the applicant-wife seeking transfer of matrimonial proceeding bearing Hindu Marriage Petition No.1/2024, from the Court of learned CJSD, Bhoom Dist. Dharashiv to the Court of learned CJSD, Ambejogai Dist. Beed.

It is the case of the applicant wife that she is residing with her old aged parents at Lonigat Taluka Parli Vaijinath. The distance between Bhoom to Ambejogai is around 120 k.m. as there is no one to

( 2 ) accompany her to travel to Bhoom. She has already filed a proceedings bearing No.635 of 2023 under Section 125 of Cr.P.C. for maintenance in the Court at Parli where the husband has already appeared. She thus prays for allowing the application.

Considering the convenience of the applicant-wife, this Court finds that it would be in the interest of justice to allow the application. Hence, the following order:-

ORDER

(i) Misc. Civil Application stands allowed.

(ii) The proceedings of Hindu Marriage Petition No.1/2024, pending before the learned CJSD, Bhoom Dist. Dharashiv stands transferred to the Court of learned CJSD, Ambejogai Dist. Beed. (iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with such application, so as to compensate the respondent-husband, if he personally remains present.

( 3 ) (iv) Whenever request is made by the respondent-husband seeking permission to appear through video conferencing, the same shall be considered liberally by the trial Court.

(v) With this, Misc. Civil Application stands disposed off. [KISHORE C. SANT, J.]
