Though the respondent No. 2 is served, none appears for the respondent No. 2. This Court vide order dated 17.02.2015 had directed the respondents not to refrain the petitioner from prosecuting further studies only on the ground that validation proceedings are pending. The learned counsel submits that, the respondent No. 2 is also insisting for payment of full fees, as the validation proceedings are pending.

It would not be appropriate to ask the petitioner to deposit the full fees as a regular student, however, an undertaking can be
2 wp 1815.15 obtained to the effect that, in case her claim is invalidated the petitioner shall deposit the entire fees.

In the result, we pass the following order.

The respondent No. 3/Committee shall decide the tribe claim of the petitioner expeditiously and preferably within a period of nine (9) months from today. The petitioner shall cooperate in expeditious disposal of said proceedings. The respondents shall not refrain the petitioner from prosecuting further studies, nor shall ask the petitioner about deposit of fees as that of a open category student, till the validation proceedings are decided. The petitioner shall file an undertaking to the effect that, in case her claim is invalidated, the petitioner shall deposit entire fees as that of an open category student. The writ petition is disposed of with aforesaid observations and directions. No costs.
